Terms of Use

On this page

These Terms of Use govern your use of IntelliWealthPro — the website at https://intelliwealthpro.com, the distributor back office, the client portal and the mobile app — which is built and operated by Devstree (Devstree IT Services Private Limited, "we", "us"). By creating an account, signing in or using the service, you agree to these terms. If you use IntelliWealthPro on behalf of a firm, you confirm that you are authorised to accept them for that firm.

Who these terms apply to

  • Distribution firms — mutual fund distributors (MFDs) and their staff who subscribe to IntelliWealthPro to run their business ("the firm").
  • Investors — clients of a firm who are invited by that firm to use the client portal or app.
  • Visitors — anyone reading the public website, blog or calculators.

A firm's subscription may also be governed by a separate order form or agreement. Where that agreement conflicts with these terms, the agreement prevails for that firm.

What IntelliWealthPro is

IntelliWealthPro is software. It helps a distribution firm keep its book of clients, read registrar feeds from CAMS and KFintech, import Consolidated Account Statements (CAS), prepare portfolio, capital gains and SIP reports, communicate with clients, and give clients a portal to see their own investments.

IntelliWealthPro does not place orders, hold money or units, or act as a distributor, investment adviser, broker or registrar. It does not give investment, tax or legal advice. Please read the Disclaimer.

Accounts and access

  • Firms register at the distributor sign-up page and are responsible for every account they create for their staff and clients.
  • Keep your password confidential, and tell your firm or us at once if you suspect someone else has used your account.
  • Investor accounts are created by invitation from the firm that services the investor. An investor sees only the data that firm holds about them.
  • We may suspend an account to protect the service, other users or their data, or where these terms are breached. Where reasonable, we will tell you first.

The firm's responsibilities

A firm using IntelliWealthPro:

  • holds the registrations its business needs (for example a valid ARN from AMFI) and follows the rules that apply to it, including SEBI and AMFI requirements for distributors;
  • has a lawful basis, including consent or notice where required, for the personal data of its clients that it records, imports or uploads, and is the data fiduciary for that data under the Digital Personal Data Protection Act, 2023 (see the Privacy Policy);
  • uses the client messaging features only for clients who may lawfully be contacted, and honours their opt-outs;
  • checks figures before relying on them or sharing them with clients, and is responsible for any advice or recommendation it gives;
  • gives role-based access to its staff that matches their job.

Acceptable use

You must not:

  • use the service for anything unlawful, fraudulent or misleading, including mis-selling or making promises of returns;
  • upload data you have no right to hold, or malicious files;
  • try to access another firm's or another person's data, or bypass access controls;
  • probe, scan, overload or disrupt the service, or reverse-engineer it except where the law allows;
  • copy, resell or build a competing product from the service or its content.

Data and content

  • The firm's data stays the firm's. We process it to provide the service, as described in the Privacy Policy. We do not sell it.
  • Third-party data. Holdings, transactions and NAVs come from registrars, CAS files, AMFI and other sources. We do not control those sources; data may arrive late, be incomplete or contain errors, and the figures built from it will reflect that.
  • AI features. Ivy, the AI assistant, generates text with a language model. Its answers can be wrong; check them against the underlying reports before relying on them.
  • Feedback. If you send us suggestions, we may use them to improve the service without obligation to you.

Fees

Fees, billing cycles and usage limits for firms are set out in the firm's plan or order form. Investors invited by a firm do not pay us. Unless agreed otherwise, fees are exclusive of applicable taxes, including GST.

Availability and changes

We work to keep IntelliWealthPro available and accurate, but it is provided "as is" and "as available". There may be planned maintenance, interruptions, or delays in registrar feeds. We may change, add or remove features; we will give firms reasonable notice of changes that materially reduce what they pay for.

Intellectual property

The software, design, text and trademarks of IntelliWealthPro belong to us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the service under these terms for as long as your account is active.

Limitation of liability

To the extent the law allows:

  • we are not liable for investment decisions, losses from market movements, tax positions taken, or advice given by a firm to its clients;
  • we are not liable for errors in data supplied by registrars, CAS files, AMFI or other third parties;
  • we are not liable for indirect, incidental or consequential losses, or loss of profit, revenue or goodwill;
  • our total liability to a firm in any twelve months is limited to the fees that firm paid us for the service in those twelve months.

Nothing in these terms limits liability that cannot be limited by law.

Indemnity

A firm will indemnify us against claims by its clients or by authorities that arise from the firm's own conduct, its breach of these terms, or data it uploaded without a lawful basis.

Ending the service

A firm may stop using IntelliWealthPro at any time under the terms of its plan. We may end an account for a serious or repeated breach of these terms. When a firm's account ends, it may ask for an export of its data within a reasonable period; after that we delete or anonymise the data as described in the Privacy Policy, except what we must keep by law.

Governing law and disputes

These terms are governed by the laws of India. The courts at Ahmedabad, Gujarat, India have exclusive jurisdiction over any dispute arising from them, subject to any dispute-resolution clause in a firm's agreement with us.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. If you keep using IntelliWealthPro after a change takes effect, the updated terms apply.
